Terms & Conditions

The services provided by Grigio Gran Turismo have been legally checked by the UK Law firm Edward Harte.

BACKGROUND

  1. The consultant conducts the business known as  Grigio Gran Turismo Services

  2. The client has agreed to utilise the services of the consultant and the consultant has agreed to provide those services to the client in the business on the terms set out in this agreement.

  3. The consultant provides networking, supercar ownership advice and property investment coaching for clients.  The consultant is not a tax advisor or a financial advisor. 

  4. The client accepts and acknowledges that the value of investments can go up and down; over which the consultant has no control.

1. Term

The consultant will provide services to the client from  for variable period  of months as needed by the client.

3. What is included

3.1 One-to-one consulting via zoom fortnightly 40 minutes maximum excluding Saturday 4pm to midnight and Sunday all day.

3.2 Live chat on LinkedIn for questions

3.3 Inclusion on WhatsApp group

3.4 Property investment spreadsheets

3.5 Property book

3.6 Property team introductions (mortgage broker, accountant, solicitor)

3.7 Annual dinner held in London at supercar event

3.8 Access to the above services

3.9 Virtual consulting in most part and face to face at networking events or masterclasses

 

4. We are not responsible for delays outside of our control

If our supply of your service is delayed by an event outside our control, such as for an unforeseen or unavoidable event or situation which is beyond our control including but not limited to fire, flood, riot, strike, war, pandemic or government restrictions, we will contact you as soon as possible to let you know and do what we can to reduce the delay.  As long as we do this, we won’t compensate you for the delay, but if the delay is likely to be substantial you can contact us on: grigiogranturismo@gmail.com  to end the contract and receive a refund for any services you have paid in advance, but not received, less reasonable costs we have already incurred.

5. Fees

The client will pay the consultant a fee of  per hour plus VAT. The client shall pay an initial payment.  The final payment of  shall be made on a chosen  date.

 

6. We charge interest on late payments

If we’re unable to collect any payment you owe us we charge interest on the overdue amount at the rate of 4% a year above the Bank of England base rate from time to time.  This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment.  You pay us the interest together with any overdue amount.

 

7. We pass on increases in VAT

If the rate of VAT changes between your order date and the date we supply the service, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

 

8. We charge you if you don’t give us information we need [or do preparatory work as agreed with us]

We charge you additional sums if you don’t give us information we’ve asked for about how we can access your property to provide the service or if you don’t do preparatory work to prepare for services, as agreed with us.  For example, we might need to reschedule services if transport or weather problems prohibit the service taking place.

 

9.  You have a legal right to change your mind

9.1 Your legal right to change your mind.  For our services you have 14 days after the date we confirm your order to change your mind about a purchase, but:

  • You lose the right to cancel any service, when it’s been completed (and you must pay for any services provided up to the time you cancel).

9.2 How to let us know and what happens next.  If you change your mind, contact us on grigiogranturismo.com attached to the terms and conditions at the end.  We will refund you as soon as possible and within 14 days of you telling us you have changed your mind.  We refund you by the method you used for payment.  We do not charge a fee for the refund.

 

10. You have rights if there is something wrong with your service.

If you think there is something wrong with your service, you must contact us grigogranturismo.com  Your legal rights are summarised below.  These are subject to certain exceptions.  For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk.  Remember too that you have several options for resolving disputes.

Summary of your key legal rights 

As your product is services, the Consumer Rights Act 2015 says:

  • You can ask us to repeat or fix a service if it's not carried out with reasonable care and skill, or get some money back if we can't fix it.

  • If a price hasn't been agreed upfront, what you're asked to pay must be reasonable.

  • If a time hasn't been agreed upfront, it must be carried out within a reasonable time.

 

11. We can change services and these terms

11.1 Changes we can always make.  We can always change a service:

  • To reflect changes in relevant laws and regulatory requirements 

  • To make minor technical adjustments and improvements, for example to address a security threat.  These are change that [don’t affect your use of the service.

11.2 Changes we can only make if we give you notice and an option to terminate.  We can also make the following types of change to the service or these terms, but if we do so we will notify you and you can then contact us at grigiogranturismo.com  to end the contract before the change takes effect and receive a refund for any services you have paid for in advance but not received:

12. We can suspend supply (and you have rights if we do)

12.1 We can suspend the supply of a service.  We do this to:

  • Deal with technical problems or make minor technical changes;

  • Update the service to reflect changes in relevant laws and regulatory requirements; or 

  • Make changes to the service (see We can change services and these terms)

12.2 We let you know, may adjust the price and may allow you to terminate.  We contact you in advance to tell you we are suspending supply, unless the problem is urgent or an emergency.  If we suspend the service for longer than 6 months in any 12 month time period we adjust the price so you don’t pay for it while its suspended.  If we suspend supply, or tell you we are going to suspend supply, for more than 6 months you can contact us on grigiogranturismo.com.

12.3 We can withdraw services

We can stop providing a service.  We let you know at least 1 month in advance and we refund any sums you have paid in advance for services which won’t be provided.

 

13. We can end our contract with you

We can end our contract with you for a service and claim any compensation due to us if:

  • You don’t have any payment to us when it’s due and you still don’t make payment within 7  days of our reminding you that payment is due;

  • You don’t within a reasonable time of us asking for it, provide us with information, cooperation or access that we need to provide the service, for example, email address, business address and telephone number

  • [OTHER CIRCUMSTANCES]

  • We don’t compensate you for all losses caused by us or our services

We are responsible for losses you suffer caused by us breaking this contract unless the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).

  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section We're not responsible for delays outside our control. 

  • Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use. 

  • A business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.

14 You have several options for resolving disputes with us

14.1 Our complaints policy.  Please contact us grigiogranturismo@gmail.com and they will do their best to resolve any problems you have with us or our services as per our Complaints policy.

14.2 Resolving disputes without going to Court.  Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court if you are not satisfied with the outcome you can still go to court.

14.3 You can go to Court.  These terms are governed by English Law and we agree to submit to the jurisdiction of the courts of England and Wales.

 

15. Other important terms apply to our contract

15.1 We can transfer our contract with you, so that a different organisation is responsible for supplying your service.  We will contact you to let you know if we plan to do this.  If you are unhappy with the transfer you can contact us on grigiogranturismo@gmail.com.to end the contract within 28 days of us telling you about it and we will refund you any payments you have made in advance for services not provided.

15. 2 You can only transfer your contract with us to someone if we agree to this.  We may not agree if .  We can require the new owner to prove you transferred the service to them, for example by written documentation.

15.3 Nobody else has any rights under this contract.  This contract is between you and us.  Nobody else can enforce it and neither of us will need to ask anybody else to sign off on ending or changing it.

15.4 If a court invalidates some of this contract, the rest of it will still apply.  If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

15.5 Even if we delay in enforcing this contract, we can still enforce it later.  We might not immediately chase you for not doing something (like paying) or for doing something you are not allowed to, but that doesn’t mean we can’t do it later.

15.6 Confidentiality  The existence and terms of the contract between us and information provided in connection with its performance are confidential and you and us must treat this information confidentially. You and us must not, and must ensure that any person who with approval receives the information does not, disclose any of the information in any form to anyone else or use any of the information except to perform its obligations under this agreement.

15.7 Intellectual property rights. Intellectual property rights include but are not limited to any patent, trademark, service mark, registered design, copyright, design right, right to extract or exploit information from a database, database rights, know-how, confidential information or process, any application for any of the above, and any other right recognised in any part of the world whether or not presently existing, applied for, registered or unregistered. 

All intellectual property rights remain the property of us and cannot be used by you without our written permission.

15.8 We charge costs We will charge you reasonable legal costs we reasonably incur if you fail to pay our fees or you breach these Terms and Conditions.
